2-A. 7º, I). 7º, IX; seção 1): investigar abuso no cartão. Estamos providenciando. Preferimos escrever isto do que omitir. 6. O SEU CADASTRO fica enquanto você for cliente. WHO IS WHO The Venue where you got your card decides what is collected and why — in law, it is the CONTROLLER, and your relationship is with them. The Venue is the one named on your card. This Platform is the tool the Venue uses, run by MORE ASSESSORIA LTDA (CNPJ 28.241.473/0001-08), based in São Paulo – SP, Brazil, the "we" of this notice; for your card and the programme we are a PROCESSOR. We act only on the Venue's instruction, never use one Venue's members for another purpose, and never hand them to another Venue. A few decisions, though, are OURS, the same for every Venue, and for them we answer as CONTROLLER: the security of the service (the security log, the hosting company's access log and our server's error logs, section 2, and the database backup copies, section 6); the 5-year limit for deleting the record of anyone who stopped coming (section 6); our own legal obligations; and the accounts of Venues and their staff. 2. WHAT WE COLLECT This is everything we collect about you through the card: your phone number (how the Venue finds your card); your email if you give one, or the one Google passes on if you sign in with Google; your name if you give one — only what you want to be called; your birthday if you give one — day and month only, never the year; your confirmation that you are old enough (18, or 20 at venues in Thailand) — only the moment you confirmed (section 8); when you joined (and which version of the Card Terms you accepted), what you spent at that Venue, when, the points you earned, what you redeemed, at which counter and which staff member recorded it — and, from that, your level in the programme if the Venue uses levels, and how long since you last came; where you came from when you joined (the counter QR, an NFC tag, a poster, a friend's link or a link the Venue made), so the Venue knows what works; the notices the Venue sent you — the text, when, by which channel and whether it arrived — used to show them on your card, to keep the Venue under its weekly limit and to tell it whether they arrived; who referred you, if a friend's card brought you, and whom you referred; a number derived from your browser and screen size, used for ONE thing — stopping someone referring themselves for a bonus; whether you agreed to receive messages — that tick box is genuinely optional: the card and the referral bonus work the same without it; and whether you turned the Venue's notices off — we keep that "no" precisely so we can honour it; unstored, the Venue would notify you again tomorrow. TECHNICAL DATA, to run the card safely: the IP address, the time and your card's identifier for three of your actions, in a security log — when you give or change your birthday and when you turn the notices on or off — used to investigate abuse, such as someone tampering with another person's card; if you add the card to Apple Wallet, a device code and a push address your iPhone gives us so the card can update itself (they go when you remove the card); when you downloaded the card to Apple Wallet or opened the link to save it to Google Wallet; and, as on any website, the hosting company logs every visit — the IP address, the time, the page address (including your card's link) and the browser type — and keeps that log for up to 30 days. Some of our server's error logs may also contain your card's link, for the same period. We do NOT collect your location, your contacts, your photo, your ID, your payment card, or an itemised list of what you bought. The Venue enters the bill AMOUNT only. COOKIES AND WHAT STAYS ON YOUR PHONE. We use no cookies: not for advertising, not for statistics, not our own. The card pages load no program from any other company. To make the card work, your browser keeps only four things for any length of time: the code of your card at each Venue (so the Venue's NFC tag recognises you when you hold your phone to it, and so joining again on this phone opens your card), the phone country you picked, the language you picked, and, if you tapped "Not now" when the card offered to go to your wallet or your home screen, the time of that tap (so you are not asked again for a week). Two passing notes stay in the tab itself and clear on their own: what you had typed while you sign in with Google (cleared when Google sends you back to the sign-up, or when the tab closes) and a note that you have just joined (cleared when the card opens). The Venue's images (logo, cover photo and background) may be stored at an address the Venue gave; then your browser fetches them from there, and that server sees your IP address and browser type, as with any image on the web. Clearing your browser data removes all of this, and your card is not lost: the Venue finds your card by your phone number or email and can send it back to you; if you joined with Google, signing in again with the same account brings it back too. Typing the number or email again on its own does not open the card — that way nobody opens yours just by knowing your phone number. 2-A. IF YOU WORK AT A VENUE If you use a Venue's counter screen or dashboard, we also keep data about you. This is all of it. AT THE COUNTER: the initials you type when you open the counter screen (up to 12 characters). They go on every entry you make, and the Venue sees how many entries each set of initials made. They are part of the card records, which belong to the Venue: the Venue is the controller and we only process them for it (section 1). IF THE VENUE INVITES YOU BY NAME: instead of initials, the counter writes the name the Venue typed in the invitation (up to 12 characters). We keep that name, when the invitation was made and when your phone used it, and a fingerprint (SHA-256) of the personal key your phone received — never the key itself. The Venue can switch the key off for a while and back on: while it is off, we keep since when. Or it can remove you: then we erase your name, the invitation you used and the key's fingerprint. Entries you already made keep your name, because they are part of the card records. Like the initials, they are the Venue's records (section 1). The security log keeps the date, the time and the IP address of when your phone joined, for 6 MONTHS; we are the controller. When the Venue switches someone off, back on or removes them, the log keeps only an internal code for the person, never the name. IN THE DASHBOARD: the security log keeps the date, the time and the IP address of every sign-in to and sign-out from the dashboard and of what is done in it — every change, every refused request and some lookups — for 6 MONTHS, and then deletes them; we are the controller. If the Venue invited you as a MANAGER, the dashboard opens with your personal key, and each of those lines says it was you. WHEN THE VENUE ACCEPTS THE PLATFORM TERMS: we keep which Venue accepted, when, which version, a fingerprint (SHA-256) of the exact text published at that moment, and the IP address the acceptance came from. The acceptance only comes from the dashboard opened by the link we send to the Venue — a manager's key cannot accept — and that link is not a personal account, so we neither know nor keep the name of the person who clicked. The IP address goes after 6 MONTHS; the rest is kept for as long as the contract with the Venue lasts and 10 YEARS after, to prove what was agreed; we are the controller. Why we may: the security log, to comply with Brazilian law, which requires the date, time and IP of each access to be kept for 6 months (Marco Civil da Internet), and our legitimate interest in protecting the service; the acceptance record, so we can prove the contract if that is ever needed, and our legitimate interest. Your rights are in section 7 and the contact is in section 9. 3. WHY WE MAY DO THIS To make the card exist — performing what you asked for when you joined. To post news INSIDE THE CARD you added to your own phone — the Venue's legitimate interest: you went to their screen and asked for this card, and the note is the Venue speaking inside it. One tap on the card turns it off, and the Venue stops immediately. To message YOUR PHONE OR EMAIL — only with your consent, that tick box, withdrawable at any time. Different rule on purpose: you gave your number so the Venue could find your card, not to be advertised to. To stop referral fraud — the Venue's legitimate interest, using the smallest possible signal: that browser number. To let the Venue choose whom to send a notice — by where you came from, your level or how long since you last came — the Venue's legitimate interest. The notice itself follows the rules above. To keep the security log — our legitimate interest (section 1): investigating abuse of a card. On both notice channels — the note on the card and the message to your phone or email — your NO outranks your YES: turning the notices off stops BOTH, even with the box ticked. That is your right to object, and it lives under the notice itself, on the card — not buried in a settings page. Turning notices off does NOT delete your card or your points. 4. WHO WE SHARE WITH The Venue where you joined — always. Other Venues — never. Sold or rented to anyone — never. Three suppliers take part: GOOGLE, in two situations only — if you tap to save the card to Google Wallet (on that tap the card, with your name if the Venue shows it, and your balance go to Google, where the card lives), and if you tap "Continue with Google" (you go to Google's own page to choose the account, and from what Google sends back we use only your email; no Google program loads on our pages, so if you never tap it, nothing of yours reaches Google through that button; on Google's page, Google's own cookies and privacy policy apply). APPLE, only if you add the card to Apple Wallet: the card is stored on your iPhone, and when something on it changes we send your iPhone's push address to Apple, which tells the phone to fetch the new card. The signal carries nothing from your card. And RAILWAY, the hosting company where the server and database live; we engage it only to host the system. Inside Apple Wallet and Google Wallet, what happens to your card follows Apple's and Google's own privacy policies. 5. TRANSFER OUTSIDE YOUR COUNTRY What: everything in section 2 and, if you work at a Venue, section 2-A. Where: Railway Corporation's servers in the UNITED STATES (California), where the system and the database run, and Google's servers in the United States and other countries where Google operates; if you use Apple Wallet, your iPhone's push address goes to Apple's notification service in the United States; and the daily backup copies of the database sit on a computer of our team, which today is in Thailand. Why: that is where the system runs, where the digital wallet works and where our team works. How long: while your record exists at the Venue; in the security log, 6 months; in the backup copies, 30 days (section 6). You may ask us for the full contractual clauses covering this transfer; we answer within 15 days. ⚠ DECLARED GAP: the standard contractual clauses required by Brazil's ANPD have NOT yet been signed with these suppliers. In progress. We would rather write this than omit it. 6. HOW LONG WE KEEP IT Two different clocks, and they should not be confused. YOUR POINTS expire on a period the Venue chooses — 1 to 60 months — counted from INACTIVITY: while you keep coming, they never expire. The Venue may also switch expiry off entirely. You see their period on your card. YOUR RECORD stays while you are a customer. If you stop coming, we delete your data 5 YEARS after your last activity. The clock only starts when you stop — someone who keeps coming is never deleted. The 5-year deletion is automatic: it runs every day on its own and depends on nobody remembering. Before deleting anything it takes a full copy of the database, so a mistake of ours is reversible rather than final. You need not wait 5 years: ask us to delete at any time and we delete and confirm. THE SECURITY LOG keeps each line for 6 MONTHS and then deletes it, on its own, in the same daily run. Its lines from section 2 (IP address, time and your card's identifier) may stay there until then even after your record is deleted. THE BACKUP COPIES: we keep at least one copy of the database a day, on a computer of our team, and a full copy on the hosting company's server before each automatic deletion. Each is discarded when it turns 30 DAYS old; until then, someone deleted from the database remains in it. If a night's copy fails, discarding waits for the next good copy, so a failure never leaves us with none. 7. YOUR RIGHTS Know whether we hold data about you and what it is; get a copy; correct it; have it deleted; take it to another service; withdraw message consent; know who we share with; object and ask for an explanation. Answered within 15 days, free of charge. If you are not satisfied with our answer or the Venue's, you can complain to the data protection authority: in Brazil, the ANPD (Autoridade Nacional de Proteção de Dados); in Thailand, the Personal Data Protection Committee (PDPC). 8. MINORS This programme is for people aged 18 and over, and 20 and over at venues in Thailand, where adulthood starts at 20. To get a card you must confirm you are that age or older, and a signup without that confirmation is REFUSED — not only on the screen, but on the server. We do NOT ask for your date of birth to do this. Asking for the year would collect more personal data than the confirmation already settles, and we would rather hold less. What we record is only THE MOMENT you confirmed. Anyone who joined BEFORE this barrier existed keeps their card, and their record stays blank — because that is the truth: we did not ask. If you are a parent or guardian and find a minor has joined, write to the contact in section 9: we delete it immediately, no questions. 9.
